- These terms and conditions (the "Terms") govern the use of the Hazfinder ("the Platform", "we" or "us") and any services or features available on the Platform. You agree to be bound by these Terms by accessing or using the Platform.
- Use of the Platform. (a) The Platform is available only to companies registered with the Pipeline and Hazardous Materials Safety Administration (PHMSA) of the United States Department of Transportation (DOT) and possessing valid hazardous materials (hazmat) registration. (b) By accessing or using the Platform, you represent and warrant that you are a US-based company registered with PHMSA and that you possess a valid hazmat registration as required by applicable laws and regulations. (c) Hazfinder reserves the right to verify the hazmat registration status of the companies and requires the users to provide proof of registration with PHMSA upon signup. (d) Hazfinder may deny or suspend access to the Platform for users who fail to provide proof of valid hazmat registration with PHMSA or who discontinue their hazmat registration. (e) Hazfinder does not provide hazmat registration services and does not endorse or guarantee the accuracy, completeness, or legality of user hazmat registration status. Users are solely responsible for ensuring compliance with all applicable laws and regulations governing hazmat transportation.
- Ownership and Intellectual Property. The Platform and all content and materials available on the Platform, including but not limited to text, graphics, logos, images, and software, are the property of Hazfinder or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use or reproduce any content or materials from the Platform without the prior written consent of Hazfinder.
- Disclaimers and Limitations of Liability. (a) No Warranty. The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. (b) Limitation of Liability. To the extent permitted by law, Hazfinder and its affiliates, officers, directors, employees, and agents will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Platform, even if Hazfinder has been advised of the possibility of such damages.
- Indemnification. You agree to indemnify and hold Hazfinder and its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Platform, your violation of these Terms, or your violation of any applicable laws or regulations.
- The truck routes provided on Hazfinder are generated using Google Maps for informational purposes only. While we strive to offer accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of the routes displayed. Users are solely responsible for assessing the suitability of the routes for their intended purpose and should exercise judgment and common sense while following the suggested paths. It's important to note that the routes displayed on this platform may not always reflect real-time conditions, such as road closures, traffic congestion, weather-related issues, or other factors that could affect travel. Users should always consult local authorities, official road signs, and adhere to traffic laws and regulations while navigating any route. Users are strongly encouraged to plan their journeys in advance, cross-check the provided information with alternative sources, and make independent decisions based on their own assessment of the situation. Reliance on the routes provided on this platform is at the user's own risk. We disclaim any liability for any loss, injury, or inconvenience sustained by any person resulting from the use of the routes or the information provided herein. By using this platform, you acknowledge and agree that the routes are provided "as is" and without any warranty or representation, express or implied, including, without limitation, the implied warranties of merchantability and fitness for a particular purpose. - Payment Processing: (a) Subscription Fees: By subscribing to the Platform, you agree to pay the applicable subscription fees as described on the Platform. Subscription fees will be charged on a recurring basis in accordance with the selected subscription plan. (b) Payment Processor: We use Stripe ("Payment Processor") to process subscription payments on the Platform. By using the Platform, you agree to comply with Stripe's terms of service and privacy policy. (c) Payment Details: We do not collect or store your payment details, such as credit card numbers or bank account information. All payment details are securely processed by the Payment Processor. By providing payment information on the Platform, you authorize the Payment Processor to charge the specified amount to your selected payment method. (d) Payment Authorization: You represent and warrant that you are authorized to use the payment method provided and that the payment information provided is accurate and complete. You agree to promptly update your payment information if there are any changes or if the information provided becomes invalid or outdated. (e) Subscription Renewal: Your subscription will automatically renew at the end of each subscription period unless you cancel your subscription before the renewal date. You authorize the Payment Processor to charge the applicable subscription fee to your selected payment method for each renewal period. (f) Payment Disputes: If you believe that a payment has been processed in error or if you have any concerns regarding a payment, please contact us immediately. We will investigate the matter and work to resolve any payment disputes in a timely manner. (g) Taxes: You are responsible for any applicable taxes, including sales tax, value-added tax (VAT), or other similar taxes, that may be imposed on your subscription fees. Subscription fees do not include any taxes, and you agree to pay any such taxes in addition to the subscription fees.
- Modifications. Hazfinder may modify these Terms from time to time. If we make material changes to the Terms, we will notify you by email or by posting a notice on the Platform. Your continued use of the Platform after such notice constitutes your acceptance of the modified Terms.
- Governing Law and Dispute Resolution. These Terms are governed by the laws of the State of Illinois. Any disputes arising out of or in connection with these Terms or the Platform will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
- Miscellaneous (a) Entire Agreement. These Terms constitute the entire agreement between you and Hazfinder with respect to the use of the Platform and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Hazfinder. (b) Assignment. You may not assign or transfer these Terms, in whole or in part, without the prior written consent of Hazfinder. Hazfinder may assign or transfer these Terms, in whole or in part, without your consent. (c) Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. (d) Waiver. The failure of Hazfinder to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. (e) Contact Us. By using Hazfinder Load Board, you agree to comply with these terms and conditions. Failure to comply with these terms may result in the termination of your account or legal action.

We may use your information to conduct research and analytics, such as to understand how users interact with the Platform and to improve our services. (d) For Marketing and Advertising.
